Effective Date: March 26, 2026. These terms are intended to establish strict limits on BLEU liability and define user obligations when accessing or using BLEU services.

You represent that you are legally eligible to use the service and voluntarily assume all risks associated with marine activities, including but not limited to weather, water conditions, navigation hazards, equipment failure, and third-party conduct.
BLEU and its affiliates provide the platform, content, and services on an “as is” and “as available” basis, with no express or implied warranties of any kind, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation.
To the maximum extent permitted by law, BLEU, its parent entities, subsidiaries, affiliates, officers, directors, employees, contractors, partners, and licensors are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the platform or any trip activity.
To the maximum extent permitted by law, the aggregate liability of BLEU and its affiliates for any claim relating to the services shall not exceed the greater of (a) amounts paid by you to BLEU in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
You release BLEU and its affiliates from claims, demands, and damages (known and unknown) arising from disputes between users, operators, owners, passengers, or any third party, and from events occurring before, during, or after any booking or trip.
You agree to defend, indemnify, and hold harmless BLEU and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or related to your conduct, your content, your breach of these Terms, your violation of law, or your involvement in a trip or incident.
You are solely responsible for obeying all applicable laws, regulations, licensing requirements, safety rules, local marina and waterway requirements, and vessel operating limits. BLEU does not assume responsibility for user legal compliance.
BLEU may provide access to third-party tools, listings, payment processors, insurance services, and external content. BLEU is not responsible for third-party performance, availability, accuracy, acts, omissions, or damages resulting from third-party services.
BLEU may investigate, suspend, restrict, or terminate accounts or content at its sole discretion, with or without notice, for risk, compliance, legal, safety, fraud, abuse, or policy reasons.
Except where prohibited by law, disputes shall be resolved by binding individual arbitration, and not in court. You and BLEU waive any right to jury trial and waive participation in class, collective, representative, or consolidated actions.
These Terms are governed by applicable law designated by BLEU in its controlling legal notice. Where arbitration does not apply, exclusive venue and jurisdiction shall lie in courts selected by BLEU to the extent permitted by law.
BLEU may revise these Terms at any time. Continued use of the platform after updates constitutes acceptance of the revised Terms.
